2. Scope of Services

2.1 The Company provides waste and rubbish removal services, including collection, loading, and lawful disposal of waste from domestic and commercial premises.

2.2 The exact nature and scope of the Services will be agreed at the time of booking, based on the Customer's description of the waste and the access arrangements at the property.

2.3 The Company reserves the right to refuse to collect certain types of waste, including but not limited to hazardous, chemical, medical, asbestos-containing, or any other waste that cannot be lawfully transported or disposed of under applicable waste regulations.

2.4 The Company will use reasonable care and skill in the performance of the Services but does not guarantee that all waste will be removed if it is not safely accessible, exceeds the agreed volume, or falls outside the type of waste agreed at the time of booking.

3. Booking Process

3.1 Bookings for rubbish removal services may be made by telephone, email, or other communication methods offered by the Company from time to time.

3.2 At the time of booking, the Customer must provide accurate information regarding the type, estimated volume, and location of the waste, as well as any access restrictions or special requirements.

3.3 Any quotation provided before viewing the waste is an estimate only and is based on the information supplied by the Customer. The final charge may vary once the team has inspected the waste on site.

3.4 The Agreement between the Customer and the Company is formed when the Customer accepts a quotation or estimated price and the Company confirms the booking, either verbally or in writing.

3.5 The Customer is responsible for ensuring that someone with authority is present at the property at the agreed time to grant access, confirm the scope of work, and approve any variation to the original estimate if required.

4. Pricing, Estimates and Variations

4.1 Prices are generally based on the volume, weight, type of waste, and the time required to complete the work, as well as any additional services requested by the Customer.

4.2 Where possible, the Company will provide an estimate or quotation before the commencement of the work. This estimate may be subject to change following an on-site assessment by the collection team.

4.3 If, upon arrival, the waste is substantially different in type, volume, or location from that originally described, the Company may revise the price. Any additional charges will be discussed with the Customer before work proceeds.

4.4 If the Customer does not agree to the revised price, the Company may cancel the job and reserves the right to charge a call-out or cancellation fee to cover costs incurred.

5. Payments and Invoicing

5.1 Payment is due on completion of the Services unless otherwise agreed in writing prior to the commencement of the work.

5.2 The Company accepts various methods of payment, which may include cash, bank transfer, or card payment, subject to availability at the time of service.

5.3 For business Customers or account holders, the Company may issue an invoice payable within an agreed period. If no period is specified, payment shall be due within 14 days of the invoice date.

5.4 All prices are quoted exclusive of any applicable taxes unless expressly stated otherwise. Where applicable, taxes will be added at the prevailing rate.

5.5 If the Customer fails to make payment on the due date, the Company reserves the right to charge interest on the overdue amount, to recover reasonable costs of debt collection, and to suspend any further services until all sums due have been paid in full.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or reschedule a booking by giving the Company reasonable notice prior to the agreed arrival time.

6.2 Cancellations made less than 24 hours before the scheduled appointment may incur a cancellation fee to reflect the cost of allocated resources and lost opportunity.

6.3 If the Company arrives at the agreed location and is unable to gain access, or the Customer is not present to approve the work where required, the Company may treat the appointment as cancelled and may charge a call-out or cancellation fee.

6.4 The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, severe weather, traffic delays, staff illness, or safety concerns. In such cases, the Company will notify the Customer as soon as reasonably practicable and offer an alternative appointment.

7. Customer Obligations

7.1 The Customer must ensure safe and reasonable access to the waste for the Company’s collection team, including access to communal areas, driveways, alleys, and relevant parts of the property.

7.2 The Customer must obtain any necessary permissions, consents, or permits required for access to the property, including from landlords, managing agents, neighbours, or local authorities as appropriate.

7.3 The Customer must ensure that the waste to be removed is clearly identified and separated from items that are not to be taken. The Company will not be liable for removing items that were not intended to be disposed of if they were not clearly separated or identified.

7.4 The Customer confirms that the waste does not include any prohibited or hazardous materials. If such materials are discovered, the Company may refuse to remove them and may charge for any time already spent on site.

8. Waste Regulations and Environmental Compliance

8.1 The Company is committed to carrying out rubbish removal and waste collection in compliance with all applicable UK waste management laws and regulations.

8.2 All waste collected will be transported to authorised disposal or recycling facilities in accordance with legal requirements and best environmental practices, wherever reasonably possible.

8.3 The Customer acknowledges that certain items may need to be treated, processed, or disposed of separately under waste regulations and that this may affect the cost and method of collection.

8.4 The Company may, where required by law, issue waste transfer documentation and maintain records of waste disposal, including details of the Customer, the type of waste, and the destination facility.

9. Property and Site Condition

9.1 The Company will take reasonable care when carrying out rubbish removal services at the Customer’s premises. However, the Customer accepts that some minor scuffs, marks, or disturbances may occur when moving heavy, bulky, or awkward items.

9.2 The Customer is responsible for making the area safe and clear for the Company’s team to work, including securing pets, moving fragile items, and identifying any hazards such as loose flooring, exposed nails, or unsafe structures.

9.3 The Company will not be liable for any pre-existing damage, defects, or unsafe conditions at the property, nor for any damage that arises as a result of such conditions.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud, or any other liability that cannot be excluded under applicable law.

10.2 Subject to clause 10.1, the Company shall not be liable for any indirect, consequential, or special losses, including loss of profits, loss of business, or loss of opportunity, arising out of or in connection with the provision of the Services.

10.3 Subject to clause 10.1, the total liability of the Company to the Customer in respect of any claim arising out of or in connection with the Agreement shall be limited to the total price paid or payable by the Customer for the Services giving rise to the claim.

10.4 The Customer shall promptly notify the Company of any claim or complaint in relation to the Services, and in any event within 7 days of completion of the relevant work, to allow the Company a reasonable opportunity to investigate and, where appropriate, remedy the issue.

11. Insurance

11.1 The Company maintains appropriate insurance cover in respect of its operations, including public liability insurance, subject to the terms, conditions, and exclusions of the relevant policies.

11.2 Details of insurance cover can be made available to the Customer on reasonable request.

12. Delays and Events Beyond Our Control

12.1 The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to severe weather, traffic disruptions, strikes, public emergencies, or the actions of third parties.

12.2 In such circumstances, the Company will use reasonable efforts to minimise the disruption and, where necessary, to reschedule the Services.

13. Complaints and Dispute Resolution

13.1 The Company aims to deliver a professional and reliable rubbish removal service. If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible with full details of the issue.

13.2 The Company will investigate all complaints in good faith and seek to resolve them promptly, which may include revisiting the site, providing clarification, or offering a suitable remedy where appropriate.

13.3 If a dispute cannot be resolved directly between the parties, either party may consider seeking advice from an independent advisor or pursuing any rights available under applicable law.

14. Data Protection and Privacy

14.1 The Company may collect and process personal information about the Customer as necessary to accept bookings, provide Services, issue invoices, and manage the business relationship.

14.2 The Company will handle personal data in accordance with applicable data protection law and will take reasonable steps to keep such information secure.

14.3 The Customer agrees that their contact details may be used for service-related communications, including booking confirmations, updates, and invoices.

15. Amendments to These Terms

15.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or the nature of the Services.

15.2 The version of the Terms and Conditions in force at the time of the Customer’s booking will apply to that Agreement, unless a change is required by law or the parties agree otherwise in writing.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any Agreement between the Customer and the Company shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided, without affecting the right of the parties to resolve disputes through alternative dispute resolution mechanisms where both parties agree to do so.

By booking or using the rubbish removal and waste collection services of Rubbish Removal Knightsbridge, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
